The theoretical foundations of individual and collective interests presented in endowment life insurance and shown why there is a tension between interests and how the anticipatory legislator tries to resolve this tension. Subsequently, on the basis of four main topics, the case law, especially from the years 2012 to 2016, is presented and the conflicting interests of policyholders are shown and how the respective case law attempts to resolve these conflicting interests.
The dissertation is intended to explain the theoretical foundations of the tension between individual and collective interests, but at the same time provide a practical approach to interpreting the case law through the extensive analysis of case law.
